Con etiquetas, pero correctamente

Los agentes económicos saben conducirse en dos escenarios: la incertidumbre y la previsibilidad. Ambos fenómenos no le resultan ni extraños ni anormales. Para cada uno de ellos definen estrategias que les permite desarrollar su negocio. Sin embargo, no se conocen aun recetas para aquellos países que decididamente abogan por ahuyentar inversiones, obstaculizar el comercio y poner en riesgo fuentes de trabajo, utilizando premisas que aparentan solucionar los problemas de la sociedad, cuando en el fondo los ocasionan.

Recientemente, la legislatura provincial de Tierra del Fuego prohibió por ley la cría de salmones en su territorio. No hubiese sido más aconsejable adoptar o imponer técnicas que fuesen sustentables, bajo un estricto mecanismo de control de su cumplimiento. No hubiese sido adecuado preservar esta actividad económica que genera un commodity de alto valor exportable, bajo mecanismos probados que minimicen el impacto en la salud de sus consumidores.

En los próximos días será el turno de los diputados nacionales, quienes se muestran deseosos por obstaculizar el proceso de reactivación económica del país, al tratar el proyecto de etiquetado frontal, que, como consecuencia del proyecto con dictamen de mayoría, lisa y llanamente, demoniza una serie de alimentos, que contienen nutrientes críticos, como el azúcar, y que forman parte del tejido productivo de numerosas provincias.

En un informe reciente sobre perspectivas económicas mundiales, la OCDE ya advirtió que la Argentina sería el último país del G20 en recuperar el PBI que tenía antes de la pandemia. Su estimación proyecta que esto sucederá recién en el segundo trimestre de 2026. La sumatoria de este tipo de decisiones, traerá como consecuencia la sanción de la ley de etiquetado frontal que confirmará la estimación de la OCDE y la hará inclusive ser muy optimista.

La mal llamada “Ley de Promoción de la Alimentación Saludable” subestima la habilidad de los consumidores para seleccionar una dieta variada, imponiendo un modelo punitivo, que provoca temor e incongruencias. La imprecisión manifiesta, al determinar que un producto debe adoptar la visualización de los sellos octogonales negros, no constituye un elemento de advertencia en la comunicación sino un castigo para su comercializadores.

El sistema chileno, diferente al proyecto argentino en la manera que define la utilización del etiquetado, con 5 años de implementación, muestra que los efectos generados no fueron los deseados oportunamente por el legislador. Aunque en los primeros meses de aplicación de la norma hubo una migración en el consumo hacia productos sin sellos, luego esto se estancó y volvió casi al mismo punto de partida. Según los expertos, los índices de obesidad en la población no mostraron mejoras sustancialmente medibles.

En esta línea, después de algunos años de vigencia de la ley, Chile era aún el país con mayor tasa de obesidad y sobrepeso de los países miembros de la OCDE, con un 74,1%. La tasa de obesidad infantil, que en los países miembros de la OCDE rondaba un 19,5%, alcanzaba en el 2019 en Chile un 25%. Su propio ex ministro de salud, Jaime Mañalich, afirmó que Chile apostó demasiado al etiquetado de alimentos como política pública, dejando de atender otros aspectos más relevantes, como la educación para combatir la obesidad.

La responsabilidad por combatir una afección tan seria a la salud como es la obesidad no puede recaer exclusivamente en la industria, utilizando mecanismos que en apariencias lo soluciona. Es necesario asumir una responsabilidad conjunta con las autoridades en pos de sensibilizar sobre mejores hábitos alimenticios, promover la actividad física, etc.

Como dijimos, el criterio para definir la imposición de sellos para nuestro país resulta más arbitrario que para la normativa chilena. En nuestro caso, el perfil de nutrientes establecido impone umbrales extremadamente exigentes, y no contempla ningún tipo de flexibilidad o gradualidad en la aplicación de los sellos negros.

De esta manera, la industria tiene pocos incentivos a innovar, dado que, mientras que, en muchos productos, esfuerzo tecnológico mediante, se podría avanzar en una disminución importante de sodio, azúcar o grasas, etc., las empresas, al no lograr situar sus productos por debajo de los límites establecidos, quedarán igualmente rotulados que aquellos de competidores que no hacen ningún esfuerzo de reducción, haciendo imposible diferenciarse en el mercado para que los consumidores puedan diferenciarlos y cambiar sus hábitos de compra.

También observamos que al proponerse la utilización del perfil de nutrientes de la OPS es extremadamente exigente en sus umbrales, de manera que llegaría a aplicarse al 91% de los productos envasados, y no es cierto que todos esos productos sean poco saludables. Dentro de esos productos, dos tercios son alimentos que las guías alimentarias recomiendan consumir, de manera que se generaría una contradicción importante y por ende una severa confusión en el consumidor.

Hemos escuchado a múltiples asociaciones resaltar la conveniencia de la utilización de esta mecánica de advertencia en los productos. Sin embargo, consideramos que podría legislarse de mejor manera. No nos parece oportuno usar los octógonos negros habiendo otros modelos efectivos y probados en el mundo, como por ejemplo el Nutri-Score, el mejor evaluado y utilizado en Europa.

Otro elemento es que el diagnóstico del cual parte esta propuesta de ley está centrada exclusivamente en discriminar alimentos por su condición de procesados. El problema de nuestra alimentación no tiene que ver exclusivamente con el consumo de alimentos procesados, también tiene que ver con el adecuado consumo de frutas, verduras, legumbres, cereales integrales y lácteos, y el exceso de harinas refinadas y azúcares en infusiones.

Finalmente, y como AmCham Argentina lo ha expresado en múltiples audiencias y reuniones con los diputamos, creemos que normas de estas características deben estar alineadas y validadas con el resto de los países del Mercosur, siendo éste el ámbito lógico y natural para abordar esta temática.

El desafío para nuestros diputados es legislar mecanismo que ofrezcan información directa y clara a la hora de elegir y comprar, punto de partida para promover políticas públicas tendientes a prevenir las enfermedades crónicas no transmisibles, como diabetes, hipertensión y afecciones cardiovasculares, entre otras, y con clara evidencia científica. Por eso promovemos la implementación de etiquetas de advertencia en los productos para cumplir con este objetivo, pero de manera clara, sustentable, equitativa y eficaz.
